Please read these Wristband Term of Use ("Terms" or "Understanding") carefully, as they affect your future legal rights. These Terms apply to the Coachella Valley Music & Arts Festival (the "Event").

All Event wristbands and vehicle passes (collectively, "Wristbands") are subject to these Terms. By accepting possession or past using any Wristbands, User agrees to all Terms and is legally bound to comply with these Terms. The original Authorized Purchaser and any Authorized Recipient agrees to inform all of their respective guests of these Terms with due diligence. The Issue producer reserves the right, at its discretion, to change, modify, add together, or remove portions of these Terms at any time. Delight check back periodically for changes.

Unauthorized Transfers Prohibited

All publicly sold Wristbands are for use by the original authorized purchaser and their invited guest(due south) only (each an "Authorized Purchaser"), and are not transferable by the Authorized Purchaser, any of their invited guests, or whatsoever other person. Authorized Purchasers and Authorized Recipients are referred to individually as a "User". Wristbands obtained from unauthorized sources may be counterfeit and are worthless.

Except equally provided herein, Wristbands may not exist sold, transferred, or used for any course of commercial or trade purposes, including simply not limited to promotions, contests, commercial or advertisement purposes, housing, hotels, holiday rentals, sweepstakes, charitable giveaways, or other activities absent the Event producer's prior written consent. No sponsorship, on site marketing, sampling, vending, coupon/product distribution, or other promotional action may exist conducted at the Upshot (inclusive of parking lots), absent the Upshot producer's prior written approval in each instance. Any wristbands used in violation of this provision shall be deemed revoked and void, and their bearers deemed trespassers at the Event.

Resale or attempted resale of Wristbands is grounds for termination of the license and counterfoil of the Wristband.

Authorisation Of User's Paradigm And Likeness

User grants the Issue producer (and its designees) the correct to include User'due south prototype, likeness, deportment, and statements in any alive or recorded sound, video, film, webcast, stream, or other transmission, exhibition, simulcast, or reproduction fabricated of, or at, the Event in any medium or context for any purpose, including commercial or promotional purposes, without further potency or otherwise.

Assignment Of Copyrights

Unless otherwise expressly agreed to in writing by the Upshot producer, User assigns to Effect producer the exclusive ownership to User's Personal Content and to whatsoever sound recordings taken at the event by User. Event producer may execute whatsoever assignment documents on User's behalf every bit necessary to perfect Event producer's ownership, and User appoints Upshot producer as User'south attorney-in-fact to execute any such documents for User. User further acknowledges, agrees to, and consents to Event producer registering the copyright with one or more copyright government, including but not express to the Us Copyright Office, and listing the User's contribution as anonymous.

User forever releases, waives, discharges and agrees non to sue the post-obit: the Upshot owner(southward); Event producer(s); Outcome promoter(s); Outcome performers, artists and their managers, agents, furnishing companies and representatives; the Event ticketing agency and/or ticketing services provider; Anschutz Amusement Group, Inc.; AEG Presents LLC; Goldenvoice, LLC; and their respective parents, subsidiaries, affiliates, partners, owners, members, managers, officers, directors, past and present employees, volunteers, agents, representatives, successors, trustees, successors and assigns (collectively, the "Releasees") from any known or unknown claims, losses, damages, liability, demands, actions, injury or death, including those relating to COVID-19 or any other disease or injury that User may sustain while at the Event, regardless of whether caused by the negligence or other fault of the Releasees or any tertiary party (collectively, "Claims" or, as used individually, a "Claim").

The Parties each may practice any lawful rights to seek provisional remedies or cocky-aid, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of this Agreement, if the foregoing grade action waiver and prohibition confronting grade arbitration is determined to exist invalid or unenforceable, then this entire Arbitration Agreement shall be void. If a claim is brought seeking public injunctive relief and a courtroom determines that the restrictions in the Arbitration Understanding prohibiting the arbitrator from awarding relief on behalf of third parties are unenforceable with respect to such merits (and that determination becomes final after all appeals have been exhausted), the merits for public injunctive relief will be determined in court and whatsoever individual claims volition be arbitrated. Governing Law

Except as otherwise stated in the Mediation Agreement higher up, any Claim arising from or relating to these Terms, the Event, or our dealings with 1 another, whether based in contract, tort, fraud or otherwise and regardless of the place of User's residence, is governed by, and construed in accordance with, federal and California police, without regard to conflict of laws principles. If any provision of these Terms shall be unlawful, void, or for whatsoever reason unenforceable, and so that provision shall be deemed severable from these Terms and shall non touch on the validity and enforceability of any remaining provisions.

Other Rights/Restrictions

No sponsorship, on site marketing, sampling, vending, coupon/product distribution, or other promotional/ad activity may be conducted at the Event (inclusive of parking lots), absent the Event producer's prior written approval in each instance.
